DIFC Law No. 2 of 2019 does not specify regulations that would detail unpaid leave as a separate type of leave.

 

The following is not regulated by DIFC laws regarding unpaid leave:

- Minimum duration for this type of leave;

- Requirement from the employer to provide unpaid leave as a standard, so any unpaid leave is rather a contractual initiative of the employer;

- Any specific rules regarding how unpaid leave affects the calculation of continuous service or other labor rights, these issues remain subject to the contract or company policy.

 

Unpaid leave by mutual agreement is the most common option. The employer and employee can always agree in writing to provide unpaid leave for any period.

 

To properly document unpaid leave, the following is required:

- Written consent from the other party

- Specify the duration, status of the job and that no salary is accrued.
