In the UAE, if an employee is absent from work without justification for a continuous period of 7 days or more, the employer has the right to register an absconding report in accordance with Article 50 of Federal Decree-Law No. 33 of 2021 on Regulation of Employment Relationships (as amended on 29.07.2024) and Article 28 of Cabinet Decision No. 1 of 2022 on Executive Regulation of Federal Decree-Law No. 33 of 2021 on Employment Relationship.

 

What to do:

1. The absence criteria for absconding:

- The employee must have been absent for at least 7 consecutive days.

- The absence must be unjustified and not communicated.

- The employer must make reasonable efforts to contact the employee.

 

2. Prepare required documentation regarding the data of the employee, the evidence of absence and attempts to contact (emails, messages, call logs)

 

3. File the absconding complaint (Online through MoHRE e-services portal: https://www.mohre.gov.ae or via Tasheel Center)

 

4. MoHRE will review the application. If approved, the employee's status will be marked as "absconding" in the system.
