Ministerial Decision No. 51 of 2021 On the cases in which health data and information may be stored or transferred outside the State

- Having reviewed Federal Law No. 1 of 1972 on the Competencies of Ministries and the Powers of the Ministry and its amendments;

- Federal Decree-Law No. 4 of 2016 Concerning Medical Liability;

- Federal Law No. 2 of 2019 Concerning the Use of the Information and Communications Technology in Health Fields;

- Cabinet Decision No. 11 of 2021 on the organizational structure of the Ministry of Health and Prevention, 

- and acting in the public interest,

Article 1

1. The definitions of words and phrases in Federal Law No. 2 of 2019 referred to herein shall be considered the same as the definitions of the same words and phrases in this Decision.

2. Within the meaning of this Decision the term “health services provided within the State” means any medical activity or procedure carried out by a health facility operating within the State, whether within the scope of diagnosis, prevention, treatment, rehabilitation or health monitoring.
