(1) Marriage: ‘Consequences of Marriage: Maintenance: Its Nature, Determination and Limits’ ‘Maintenance by Relatives: A Child’s Right to Maintenance from His Father’.
- Maintenance. Definition. One of the obligations arising from the marriage contract and a prominent manifestation of the husband’s guardianship over his wife within the family; the husband or father is responsible for the financial and economic care of the family during married life and following separation. Children are obliged to provide for their parents once they reach adulthood and are able to earn a living. Determination. This is assessed at the time the entitlement arises, taking into account the income of the person liable for maintenance and encouraging generosity in provision.
