(1-2) Appeal "Appeal against cassation judgments: not admissible except in final judgments." Trial proceedings "Session rules and procedures: the defendant must be present in person."
(1) Appeal in cassation. An exceptional remedy not permitted except in final judgments issued by the Court of Appeal.
(2) The defendant must appear in person for crimes and misdemeanours punishable by a fine. This is a procedural matter related to litigation and cannot be waived by agreement. If the defendant does not appear in person and a judgment is issued in absentia, the defendant is deemed to have been present ( ) and the judgment is deemed to have been served on the defendant.
