1. Proof of the incident. Its effect. Impose the legally prescribed penalty. Article 213 of the Criminal Procedure Code.
2. The judgement to suspend the execution of the sentence is conditional. Article 84/1 of the Crimes and Penalties Law.
3. The court's decision to suspend the execution of the sentence imposed on the appellant without discernment due to his criminal record for theft offences for which he was convicted and for which he was sentenced is misplaced and must be partially overturned with regard to the assessment of the sentence.
