(1-3) Ruling ‘Appeal against a cassation judgement: The condition of interest in the appeal’. ’Who has the right to appeal final appeal judgements’. Juvenile offenders. ‘Signing an undertaking is not considered a punishment or a measure’.

 

1.  Interest in the appeal is mandatory. The acceptance of appeals must be related to the person and interest of the appellant.

 

2. Who has the right to appeal a final appellate judgement issued in a felony or misdemeanour case? Article 244 of the Criminal Procedure Law.

 

3. The appellate judgement requires the juvenile to sign an undertaking that he will not violate the safety of others in relation to the charges against him. That's what it means. A judgement without a penalty or one of the measures stipulated in the Federal Law on Juvenile Delinquents  is inadmissible. This is because there is no real interest for the appellant in overturning the judgement other than a...
