1. The fraud as a crime, its elements and how it is committed is not achieved by mere false statements and allegations, but the false statement must be accompanied by material acts that lead the victim to believe in the truth of those statements. The court's failure to indicate the fraudulent methods used is insufficient reasoning.
2. A substantial defence is a defence that relates to the subject matter of the case and is necessary for the adjudication of the case and affects the legal application.
3. The court must respond to the defenses and pleas raised by the accused or his defense attorney. Reason for that.
