(1-2) Ruling Reasoning of the judgement How the judgement is reasoned. Sources of the obligation related to the harmful act: There is no requirement that the harmful act constitutes a violation for which the perpetrator is convicted by a criminal judgement in order to grant compensation.
1. Judgement. It must contain the court's knowledge of the facts of the case and its documents, not to omit a fundamental defence, not to obtain facts other than those established in the papers, and not to infer from expert reports other than what they prove.
2. The harmful act is one of the sources of obligation that creates a right for the injured party to request a guarantee of damage and compensation after proving the responsibility of the perpetrator. The formation of a harmful act is a violation for which the perpetrator is convicted by a judicial decision, which is not a requirement. The civil judge...
