- Civil Procedures ‘Judgements: Correction of judgements and their interpretation. Signature of the presiding judge on the correction.
- Correction of material errors in a court decision or judgment is permissible, provided that it is signed only by the presiding judge. The basis for that is Article 137 of the Civil Procedure Law states that the challenged judgement shall be corrected and signed by the rightmember of the Chamber. Error requiring cassation.
According to the first paragraph of Article 137 of the Civil Procedure Law, ‘The court may, by a decision issued at the request of one of the litigants or on its own initiative without pleading, correct purely material clerical or arithmetic errors in its decision or judgement.
