(1-2) Administrative Procedures Methods of appealing cassation judgements: Litigants in cassation.
1. Capacity. A condition on who is a party to the appeal that means that the appeal is directed to a person who was not a party to the litigation before the Сourt of Second Instance is impermissible on this ground. Because it involves a new litigation. Intervention, inclusion or assault is not permissible except for those who have the right to appeal and within the prescribed dates and procedures. The basis for that are Article 183 and Article 184 of the Civil Procedure Code.
2. The lack of capacity as a litigant in the case before the courts of first and second instance and his failure to include him in the case in either of the two degrees means that his request for intervention before the cassation is inadmissible.
