(1-3) Civil Procedure "Judgements Issuance of judgements. Reasoning of the judgement Corruption in reasoning, contradicting the evidence in the papers, and deficiency in reasoning".
(1) The judgement must contain an overview of the facts of the case, the parties' requests and the summary of their substantive defence. Insufficient reasoning or serious error. Its effect. Nullity.
(2) The judgement must contain an overview of the elements of the case, examine and study the evidence, and respond to the substantive defences and requests. Duty of the trial court. Failure to do so. Invalid deficiency.
(3) The appealed decision bases its decision on the expertise report filed before the Court of First Instance and refers to it even though the Court of First Instance did not assign an expert in the first place. Meaning. The Court of Appeal did not examine the case paper...
