How are individual labour disputes regulated?
Answer:
In accordance with Ministerial Decision No. 782 of 2023 Regulating the Process for Resolving Individual Labour Complaints and Article 54 of Federal Decree-Law No. 33 of 2021 on Regulation of Employment Relationships (as amended on 29.07.2024), if the employer, the worker, or any of the beneficiaries thereof dispute any of the rights, he shall submit a request to the Ministry, which will examine the request and take what it deems necessary to settle it.
The individual labor dispute complaint can be registered via MoHRE website.
1. Each of worker, employer, or any eligible person may file a labor complaint to the Ministry within 30 days from the date of violation by either of them of his obligations.
2. The law does not prescribe a specific form of evidence for labor complaints. In practice, any document that can serve as a written record (including messages on social networks, which is considered as evidence in the UAE), photographs, video recordings or expert opinions can be taken into consideration depending on the situation.
