(1, 2) Narcotic drugs and psychotropic substances: ‘The extent to which the sentence imposed for drug offences may be reduced’. (1) Reducing the sentence imposed for drug-related offences, with the exception of offences involving personal consumption or use when committed for the first or second time, and offences punishable by imprisonment and a fine or by a fine alone. Not permissible. The basis for this is as follows. (2) The contested judgment convicted the respondent of the offences of possession of a psychotropic substance with intent to traffic and of use, and commuted the sentence for the first offence from capital punishment to five years’ imprisonment, applying the provisions of Article 99 of the Offences and Penalties Act without complying with the provisions of Article 67 of the Law on Combating Narcotic Drugs and Psychotropic Substances. This constitutes an error in the application of the law, which ...
